1. Introduction and Scope of the GTC

This General Terms and Conditions ("GTC") document describes how you can purchase products on the andwetalk.com website ("Website"). Here you'll also find out how you can use the Website. The Website is operated by the Hungary-based Service Provider.

This GTC applies to purchases made without registration. The previous "Registration" and "Your Account" sections have been deleted.

The GTC applies to every contract that is concluded electronically between the Service Provider and you, as the buyer, through the Website. (Where required by law, 'buyer' means the Consumer.)

The language of the contract is Hungarian. The contract does not qualify as a written contract, and the Service Provider does not file it.

If you use the Website or make a purchase, you declare that you have read and accepted the GTC.

The current version of the GTC is always available on the Website. The Service Provider reserves the right to unilaterally modify the GTC. Changes are valid from the date of publication, but do not affect orders already placed.

Product Information

On the website, you’ll find board games and related products. You can check out the main features of the products, their gross purchase price (which includes value added tax), any promotional prices, and stock information in detail on the product page.

The Service Provider can change prices at any time, but this doesn’t affect orders that have already been confirmed.

Ordering Process

  • In the cart, you can select the desired product and quantity.
  • You can view, modify, or delete the contents of your cart at any time.
  • To place your order, fill in the details needed for shipping and invoicing, choose your payment method, then finalize your order.
  • You can correct data entry errors using the “back” buttons and by modifying your cart.
  • The contract is formed when the Service Provider confirms your order by email. If you don’t get a confirmation within 48 hours, your offer is not binding.

Payment Methods

You can choose from the following payment methods (available options may differ by country):

Cash on Delivery Pay in cash or by card to the courier upon delivery. The Service Provider reserves the right to charge a cash on delivery handling fee.
Revolut Pay Pay via the Revolut Pay system using the bank card or balance set up in your Revolut account.
PayPal Pay through the PayPal payment interface.

Invoicing

The Service Provider issues an electronic invoice for your order, which will be sent to you by email. The electronic invoice complies with Hungarian law, and you can download and keep it.

4. Shipping Terms

  1. Shipping methods: Your order will be delivered by courier services. At checkout, you can choose which courier you want for delivery; the available options may vary by country (for example, GLS, DPD, MPL, DHL, Packeta network). If available, you can also request delivery to a parcel point.

  2. Shipping fee and deadline: The shipping fee and the expected delivery time will be clearly and definitively shown on the payment page before you finalize your order, including the fee for delivery to a parcel point if applicable. Shipping costs are predictable in advance. Important: during promotional or holiday periods, delivery times may be longer. The maximum deadline for fulfilling your order is 30 days. If the Service Provider does not fulfill your order within the previously communicated deadline, you can withdraw from the contract.

5. Gift Card

The gift card is a digital, multi-purpose voucher. We send it by email to the buyer or to a recipient specified by them, at the time chosen during purchase.

Validity: the gift card is valid for 1 year from the date of purchase; the expiration date is included in the email accompanying the card. We'll remind the recipient by email before it expires. Any unused balance will expire on the expiration date.

Redemption: it can be redeemed for any product in our webshop, in one or more purchases. If the order amount exceeds the card balance, the difference can be paid using another payment method. The gift card cannot be exchanged for cash, and any remaining balance cannot be paid out.

Invoicing: the gift card qualifies as a multi-purpose voucher: when you buy it, we issue a document outside the scope of VAT, and the VAT will be included on the invoice issued at the time of redemption.

Withdrawal: you can withdraw from the purchase of the gift card without giving any reason within 30 days from the delivery of the card, provided the card has not been used. If the card has been partially or fully used, the right of withdrawal cannot be exercised.

Security: anyone can redeem the card code, so treat it like cash.

6. Right of Withdrawal (30-Day Withdrawal)

  1. Exercising your right of withdrawal:

According to the 45/2014. (II. 26.) Korm. rendelet, you can withdraw from the contract concluded remotely without giving any reason. The law provides a 14 calendar day period for this; we offer a longer deadline, so you can withdraw within 30 calendar days from receiving the product. The withdrawal period starts on the day you or a third party designated by you receives the product. If you ordered several products at once, the 30 days are counted from the day you receive the last product.

  1. Notifying your intention to withdraw:

You can exercise your right of withdrawal with a clear statement. You can send this by post or by email to support@andwetalk.com. You can use the withdrawal statement template in Annex 2 of the 45/2014. (II. 26.) Korm. rendelet, but it’s not mandatory: any clear statement is acceptable.

  1. Consequences of withdrawal:

If you withdraw, you must return the product without undue delay, but no later than 14 days from notifying us of your intention to withdraw. The cost of return is your responsibility, unless the Service Provider has agreed to cover it. We will refund you the purchase price of the product and the basic shipping cost (we do not refund shipping costs above the cheapest standard delivery) within 14 days of receiving the returned product. The refund will be made using the same payment method you chose, unless you specifically request otherwise. We may withhold the refund until we have received the product back or you have provided credible proof that you have sent it back.

  1. When the right of withdrawal cannot be exercised:

According to the law, you cannot exercise your right of withdrawal, for example:

  • if the product was made individually, based on your instructions or at your express request;
  • if the sealed product cannot be returned after opening for health protection or hygiene reasons;
  • in the case of the sale of audio or video recordings, or computer software, if you have opened the packaging;
  • for digital content not supplied on a tangible medium, if the Service Provider has started performance with your prior express consent and acknowledgment that you lose your right of withdrawal.

The detailed conditions for returns and the refund process are set out in a separate "Return Policy", which you can find here: Return Policy. There you can read, for example, about exchanges, handling damaged products, and details of refund methods.

7. Implied Warranty, Product Warranty, and Guarantee

  1. Implied Warranty:

If the product is defective, you can make an implied warranty claim against the Service Provider based on the Civil Code (Ptk.). You can do this within two years from receiving the product.

You can ask us to repair or replace the product. If that's not possible, or it would involve disproportionate extra costs, you can ask for a price reduction or withdraw from the contract. You can't withdraw because of a minor defect; a defect is considered minor if it doesn't significantly hinder the intended use of the product and fixing it would cause disproportionate extra costs.

It's important that you notify the Service Provider of the defect without delay after discovering it.

  1. Product Warranty:

If the product is defective, you can also make a warranty claim against the manufacturer or distributor. You can do this within two years from the product being placed on the market.

In this case, you can only ask for the defective product to be repaired or replaced.

A product is defective if it doesn't meet the quality requirements in force at the time it was placed on the market, or if it doesn't have the properties described by the manufacturer.

The manufacturer or distributor is exempt from liability if they prove that:

  • the product was not manufactured or distributed in the course of their business activity;
  • the defect could not have been detected based on the state of science and technology at the time it was placed on the market;
  • the defect in the product results from the application of a legal regulation or mandatory official requirement.
  1. Guarantee:

For certain durable consumer goods, Hungarian law prescribes a mandatory guarantee. From 2025, you'll also receive the guarantee certificate electronically.

From March 1, 2026, the mandatory guarantee will also apply to micro, small, and medium-sized enterprises (SMEs) if they act outside their profession, independent occupation, or business activity.

The duration of the guarantee depends on the purchase price of the product:

Board games distributed by the Service Provider are not considered durable consumer goods and each has a purchase price under 100 000 Ft, so a mandatory guarantee certificate does not apply to them. However, the Service Provider ensures the defect-free condition of the products according to the rules of implied warranty.

  1. Guarantee Certificate Electronically:

If a given product is subject to a mandatory guarantee, the Service Provider will send you the guarantee certificate in electronic form. The guarantee certificate must clearly state, in Hungarian, the Service Provider's name and address, data suitable for identifying the product (name, type, serial number or identifier), the start and duration of the guarantee, your rights arising from the guarantee, where and under what conditions you can enforce them, and information that in case of a consumer dispute, you can also turn to a conciliation board.

8. Complaint Handling Policy

If you have a complaint, you can let the Service Provider know either verbally (by phone) or in writing (by post or email). You can reach us at the following contacts:

  1. Complaint Handling Deadline:

We’ll look into your verbal complaint right away and, if we can, fix it immediately. If you don’t agree with how your complaint is handled, or if it can’t be investigated on the spot, we’ll make a written record of it. We’ll reply to you in writing within a maximum of 30 days.

  1. Legal Remedies:

If the dispute between you and the Service Provider can’t be settled through negotiation, you can turn to the following bodies:

  • Consumer Protection Authority: The county (or metropolitan) government offices responsible for your place of residence handle consumer protection procedures. You can find their contact details on the website of the Nemzeti Kereskedelmi és Fogyasztóvédelmi Hatóság (NKFH).

  • Conciliation Board: If we can’t come to an agreement, you can contact the conciliation board responsible for your place of residence free of charge, or use the new EU online dispute resolution tool. The Service Provider cooperates with the conciliation board during the procedure.

9. Limitation of Liability

We do everything we can to make sure the information on the website is accurate. However, we don't take responsibility for the accuracy, completeness, or up-to-dateness of the content.

You use the website at your own risk. It's up to you to make sure your internet connection and hardware work properly.

The content on the website (for example, images, texts, graphics) is the intellectual property of the Service Provider or third parties. You can only use this content if we've given you prior written permission.

We don't take responsibility for third-party websites and their content. If you use links to such sites, you do so at your own risk.

10. Other Provisions

  1. Partial Invalidity: If any point of the GTC is invalid or unenforceable, it doesn't affect the validity of the other provisions.

  2. Governing Law and Jurisdiction: Hungarian law applies to the GTC and the legal relationship between you and the Service Provider. In case of a dispute, you can first turn to a conciliation board. If that doesn't lead to a result, the court competent according to your place of residence will proceed (if you qualify as a consumer).

  3. Related Policies: By making a purchase, you acknowledge and accept the related policies available on the website (Shipping Terms, Return Policy, Privacy Notice). These are part of the GTC. You can find links to the policies in the website footer.
